Royal Courts of Justice Front 300x125 - Commercial Litigation

When it comes to commercial litigation, Aston Brooke has a reputation for being pragmatic and cost-effective, as well as responsive and empathetic. In many cases, our flexible and supportive fee structures result in cost-neutral dispute management for our clients. We always work tirelessly to resolve our clients’ disputes and deliver a successful conclusion.

We understand that disputes can be stressful, time consuming and damaging for your business. Therefore, we offer clear and concise advice. This starts with an early assessment of the case with careful consideration of the strategy and alternatives (if any) to a formal procedure, including Alternative Dispute Resolution (ADR). Where litigation is necessary, we have the resources and skills to represent our clients very effectively. We are not afraid to take incisive action where required. This might include applying for injunctive relief. We work in all divisions of the High Court, the County Court and in domestic and international arbitration proceedings.

ABOUT COMMERCIAL LITIGATION

Commercial litigation can be very expensive. It is therefore prudent to explore all avenues of negotiation before embarking upon litigation. Sometimes, mediation or arbitration can be preferred alternatives to litigation depending on the nature and complexity of the case. Litigation is undertaken on an hourly rate basis. We will give you the best estimate we can, based on the information we have available to us, of your potential costs if the case goes to trial.

Should litigation become necessary the matter can be funded in a variety of ways, the litigation department will discuss which funding option is best suited for your needs:

  • Conditional Fee Agreement – commonly known as No win No fee
  • Damage Based Agreement – if you are successful Aston Brooke will only be paid a percentage of your award
  • Hourly Bases – you will only be charged for the time spent on your matter and if successful Aston Brooke will recoup as much as possible from the other side
  • Legal Expense insurance (LEI)  – Most LEI is sold when you buy a car or home in insurance policy. The cover is designed to offer protection if you are faced with a litigation.
