ABOUT COMMERCIAL LITIGATION

We offer concise, clear and straightforward advice, as we understand the level of stress that commercial disputes can generate for you and your business. Commercial litigation can become damaging and very time consuming, however we place significant focus on carrying out strict diligence to ensure your case is taken care of from start to finish. We begin by conducting an initial assessment in which we consider all alternatives to formal procedures and strategies such as Alternative Dispute Resolutions or ADR.

Aston Brooke Solicitors works in every division of the County Court, the High Court and in International and domestic settlement proceedings. We have the skills and resources to effectively represent you and your business when litigation is deemed necessary. Taking incisive action on your behalf does not phase our team, such as when we may apply for an urgent injunctive relief.

The preferential alternative to litigation can include arranging a settlement or carrying out mediation as litigation is ordinarily undertaken on an hourly basis. This undoubtedly relies on the complexity and nature of the situation. What we do is give you an honest estimation of how much your case is likely to cost if it indeed does go to trial, basing that figure on the available information we receive. Funding can be achieved through different ways if litigation is the only necessary way forward.

Our litigation department will ensure that the best option is selected for you, either by:

  • Legal Expense insurance (LEI) – Most LEI is sold when you buy a car or home in insurance policy. The cover is designed to offer protection if you are faced with a litigation
  •  Hourly Bases – you will only be charged for the time spent on your matter and if successful Aston Brooke will recoup as much as possible from the other side
  • Conditional Fee Agreement – commonly known as No Win No Fee
  • Damage Based Agreement – if you are successful Aston Brooke will only be paid a percentage of your award.

Aston Brooke’s specialists can provide legal advice and assistance on a variety of commercial disputes, including but not limited to:
