Key Stages

– Request relevant information from client regarding the property.

– Seller’s Solicitor will send us the title deeds to the property and a draft contract for approval. The seller will also send a property information form highlighting leasehold information, fixtures & fittings
etc.

– Aston Brooke will carry out a range of searches on the buyer’s behalf to ensure the property they are purchasing does not have any issues that can adversely affect the buyer.

– Aston Brooke will send any ‘Pre-Contract enquiries’ the buyer has to the seller’s solicitor. The purpose of this is to obtain more information about the property and identify any issues such as structural modifications, issues with Right of Way, shared parking etc.

Timescale

– 2-3 months minimum on receipt of the contract papers if buying.

– 2-3 months minimum on issuing the contract pack to the buyer’s solicitor, if selling.

Litigation is a varied area of law, with claims ranging in their lengths and degrees of complexity. Our
litigation department generally works on the basis of our hourly rates as provided below (unless
otherwise agreed within your matter).

We will endeavour to inform you of the anticipated costs of
your matter upfront, and of any developments to these anticipated costs as we become aware of
such over the course of the litigation.

Basis of Charges

Our guideline hourly rates are currently as follows:

  • Partners / Directors – £301
  • Solicitors – £194 – £244
  • Trainee solicitors – £140
  • Paralegals and Legal Assistants – £140All hourly rates are exclusive of VAT which is charged at a rate of 20%.
Cost & Description of Disbursements

We assist in the recovery of funds owed to you. This relates to claims up to £100,000. The complexity
of the matter is highly dependent on the approach adopted by the Debtor.

What is included:
Each matter is contingent on the facts at play and a tailored approach will be provided upon instructions however below are indicative first steps:
Acting for the Claimant

  • Taking new instruction and reviewing documentation provided
  • Drafting and sending a Letter before Claim in accordance with the relevant pre-action protocol
  • Receiving payment and sending the same to you
  • If payment or resolution is not received, issuing a claim
  • Where the Defendant has failed to Acknowledge service and or Defend the matter,
    obtaining a Judgement in Default

Work not included:
The Fees set out below would not include any further work required dealing with a defended debt dispute ( whether this be through further litigation or otherwise.)

Enforcement measures taken, insolvency proceedings, adjourned or further hearings in addition to any additional, drafting witness statements, preparing trial bundles Acting for the Defendant:

What we Charge Our pricing is contingent on the complexity of the matter however range as follows:

  • Low complexity : From £2,000 – £4,000
  • Mid complexity: From £4,000 – £7,000
  • High Complexity: in excess of £7,000

Factors that determine the complexity:

  • The Debtor having a defence, counterclaim or right to set off
  • If acting for the Defendant, the Claimant filing a reply to Defence
  • There being multiple parties to the dispute
  • A high value debt
  • The debtor being difficult to locate
  • The particulars of the claim being complicated, disputed and/or obscure

Disbursements vary depending on the nature matter, the complexity and amount claimed, however likely disbursements include:

1. Court fees depend on the value of the claim and are subject to change by HMCTS, however
are not subject to VAT are currently valued as follows:

  • Up to £300, the court fee is £35
    Between £300 to £500, the court fee is £50
  • Between £500 to £1,000, , the court fee is £50
  • Between £1,500 to £3,000, the court fee is £115
  • Between £3,000 to £5,000, the court fee is £205
  • Between £5,000 to £10,000, the court fee is £455
  • Between £10,000 to £200,000, the court fee is 5% of the value of the claim Greater than £200,000, the court fee is £10,000

2. Counsel fees which are dependent on the seniority of counsel but range from £350 upwards exclusive of VAT.

3. Experts – depending the Particulars of the matter expert evidence may be relied upon in
order to strengthen a claim or defence. Starting prices usually start at £250 exclusive of VAT

4. Costs Draftsman – usually instructed on conclusion of the case, cost draftsman fees are
usually charged at an hourly rate starting at £100 exclusive of VAT

5. Tracers – should we have any difficulties locating the opposing party in respect of your
matter, tracers will be used. Fees are contingent on the company used however range from
£100-£250 plus VAT

Key Stages

All stages of a matter are covered by hourly rate excluding disbursements

  • Taking initial instructions from client.
  • If client is the party seeking to bring a claim (the Claimant), assess merits of pre-action resolution. If client is the party against whom a claim has been brought (the Defendant), assess the merits and venues of defending against the claim.
  • Collect all necessary paperwork from client, and prepare relevant correspondence and
    paperwork.
  • If client is the Claimant, prepare and submit the Claim to both the relevant Court, and
    on the Defendant party.
  • If client is the Defendant, prepare and submit the Defence.
  • Handle elements of the Claim as the court directs
Timescale

The timescale of a litigation claim for debt recovery is contingent on the complexity of a matter
however generally settlement is achieved within 8-12 months.

It can however become extended beyond this timescale depending on the complexity of the claim, and levels of engagement from the Defendant.

Grant Application and Full Administration where there is a valid Will, a single property, up to 10 beneficiaries, no disputes between beneficiaries and no assets outside England and Wales.

We anticipate this will take between 20 to 40 hours to complete and the costs will range from £5500 to £11,000 and disbursements.
